In a unanimous decision, the three judge Federal Circuit panel hearing the appeal in Helferich Patent Licensing, LLC v. The New York Times Company, et al. held that Helferich’s patents are not unenforceable under the doctrine of patent exhaustion, reversing the district court judge’s ruling holding the patents exhausted.
