The patent licensing process typically (but not always) begins after a patent is obtained from the Patent Office.
This process requires counsel to work with the inventor and specialized experts to identify the likely infringers or parties interested in acquiring the patent, and then, to communicate with those entities to determine whether an amicable business resolution can be reached. If an amicable licensing resolution is not possible, litigation may be necessary. The litigation process requires an aggressive lawyer with expert verbal and writing skills, and the determination to work long, hard hours, sometimes for several months at a time.
I can’t afford to talk to a lawyer about my patent, let alone get one and enforce it. But, I have a great idea. What do I do?”
The patent procurement process requires counsel to work closely with the inventor to assess the invention, prepare the necessary specifications and drawings for filing with the Patent Office, and ultimately and most importantly, to properly define or “claim” the invention in words. This process requires patent counsel to have excellent technical, communication and writing skills, along with a detailed knowledge of the many procedures and rules required by the United States Patent Office.
"Win or lose; the lawyers always win."
Patent litigation is extremely expensive for both patent plaintiffs and defendants. Without even including damages or royalty awards, legal costs for a single patent litigation defense can be several million dollars or more. Thus, defendants, especially small and medium sized companies are often in the difficult position of either spending significant money on legal services while facing the risk of losing, or paying patent licensing or settlement fees where meritorious defenses may exist.
Trade secrets can be a critical component of a company's intellectual property portfolio.
In order to maintain an advantage over competitors, it is important for a business to work with a legal team with experience in developing the groundwork to identify and protect confidential information for its clients and also creating a framework to discourage and prevent misappropriation. When misappropriation does happen, it can be necessary to aggressively pursue the enforcement of a trade secret claim and related claims to prevent further loss of value to the company.
Generally speaking, attorneys represent one party in a given matter, and work as an advocate for the enforcement of their client's rights.
Sometimes, however, two parties seek mediation services to resolve disputes without entering a costly and lengthy litigation. The attorneys at the Law Offices of Lisa & Lesko have considerable experience in resolving cases for both plaintiffs and defendants. We therefore understand how to fairly and objectively evaluate matters and opposing viewpoints, and to assist parties with reaching a reasonable settlement on fair and equitable terms.
